The Fair Housing Act

The Fair Housing Act (Title VIII of the Civil Rights Act of 1968, as amended) prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on:

  • Race
  • Color
  • National Origin
  • Religion
  • Sex (including gender identity and sexual orientation)
  • Familial Status (including children under 18 living with parents or legal custodians, pregnant women, and people securing custody of children under 18)
  • Disability (physical or mental)

Florida Fair Housing Act

In addition to federal protections, the Florida Fair Housing Act (Florida Statutes, Sections 760.20-760.37) provides further protections against housing discrimination in the State of Florida. The Florida Commission on Human Relations investigates and resolves complaints of housing discrimination.

What Is Prohibited

In the sale and rental of housing, the following actions are prohibited:

  • Refusing to sell or rent a dwelling based on a protected class.
  • Discriminating in the terms, conditions, or privileges of the sale or rental of a dwelling.
  • Advertising or making any statement that indicates a limitation or preference based on a protected class.
  • Representing that a dwelling is not available for inspection, sale, or rental when it is available.
  • Denying access to or membership in a facility or service related to the sale or rental of housing.
  • Threatening, coercing, intimidating, or interfering with anyone exercising a fair housing right.
